There are several types of patent searches, each with a different purpose.
Patentability Is your invention patentable?
Freedom to Use Can you use your invention without someone else’s permission?
Post Issuance Search How strong is the patent I obtained?
Patent Search Review How good was the cheap search I had done?
Citation Search Who is looking at my patent and using it in their patent and why?
This is the most common kind of search. It seeks to find out if your invention is patentable by identifying any prior art in any form in any location in the world that teaches the same idea as your invention in the same way.
AlaCarte Prior Art Searches
All our different types of patent searches make use of aspects of our unique AlaCarte process. Here is what it can do for you:
We keep you in the loop. You can follow what we do, as we do it
Combined human and machine search to get the best of both approaches
You set the round rules as to where we search and how hard – US, foreign or both
Custom report on all high rated patents with excerpts and detailed commentaries on each one
We search the way the patent office does – by Patent Class
The AlaCarte patent search process has been developed over a six year period by Business Metamorphosis LLC. The process is very different than the typical patent search which keeps customers in the dark for a lengthy period, after which they receive a pile of patents to review and a short report.
AlaCarte keeps the customer in the loop. With our online databases accessible to the customer, you are able to follow our progress whenever you want. Your decisions drive the process. You decide which prior art you want us to search (US, Europe, Japan) and how deeply. While we use automated tools, the key parts of our search are done by human beings, not machines. Patents are screened by humans and those rated “High” are read in detail. A full report with a detailed commentary on every highly ranked patent is supplied to the inventor. Our clients have found our process to be a substantial improvement over their past experiences.
Freedom to Use Searches
These searches focus on patent claims. While patentability is blocked by any kind of prior art, freedom to use is inhibited only if the claims of a valid patent which is in force teach the same idea as your invention. Abandoned patents, expired patents and materials in the public domain are all no problem in establishing your freedom to copy an invention. Even if you have no plan to patent your invention, you want to be sure that no one else already owns it unless you want a very unpleasant surprise letter from an attorney when your new product is launched and is found to infringe another patent.
Patent Search Review
Often inventors with a small budget will purchase inexpensive web-based searches. These are often narrow and may miss much prior art that could be a problem if the invention is ever challenged either by a patent examiner or by another inventor. We will review these searches and determine what areas of significance might have been omitted and what might have been missed in areas that were searched. We will then perform any additional searching the inventor chooses to authorize.
Citation searches are done after a patent has been in force for a few years and show what other patents are using the cited patent as prior art. Often these are useful tools in competitive analysis as they show the strategies of other players in the field. They are also an indication of patent strength and breadth. Important patents are frequently cited by others.
Business Metamorphosis LLC provides thorough, human produced prior art searches. We search patents the way the government does, by patent class. Other patent search companies leave most of the work to you or don’t do it at all. We work with you to create a search profile that guides the subject matter experts who do our searching. We then use this profile to identify patents which are put in an online database. We refine that database down with an initial “relevance read” to a small selection of patents that are read in detail.
We work to find the prior art that is most likely to give you and your patent attorney problems if it is uncovered by the patent office. That allows your attorney to prepare the strongest possible case for you. Everything we do goes into a private online folder so you can follow our progress at your option. We never keep you in the dark.
If we find something that is close enough to your invention to be a major problem, we use our High Flash instant notification system. You then have the option to stop the search and transfer your funding to another project. If we find such prior art during the proposal process, you can stop the search and only pay 25% of the price of a full search.
With an AlaCarte Search, you can be prepared for whatever the patent office chooses to throw at you. Request a search now using our Patent Search Information Template.
